Trade Expert Sital Kalantry: Trump's Tariff Policy Shift Gives India 'More Leverage' In Talks

A trade law expert discusses President Donald Trump’s recent tariff policy changes and their impact on India. After the Supreme Court invalidated earlier tariffs, Trump imposed a new 10% global tariff under Section 122, though he had initially mentioned 15%. The expert explains that Section 122 gives the president authority to impose up to 15% tariffs without congressional approval for 150 days, after which Congress must authorize or the tariff expires. Section 232 under a different Trade Act allows up to 50% tariffs on goods viewed as national security threats without congressional approval. For India, the shift from previously imposed 20-26% tariffs to 10% is beneficial and provides more leverage in bilateral trade negotiations. The expert advises India to proceed cautiously and adopt a wait-and-watch approach, noting that delays in trade negotiations favour India compared to countries that have already signed bilateral deals with higher tariffs.
