The Supreme Court is hearing petitions regarding the restoration of statehood to Jammu and Kashmir. The court indicated that the time is not ripe for the statehood plea and has issued a notice to the government, directing it to file a reply within eight weeks. Petitioners highlighted that 21 months have passed since the five-judge bench upheld the abrogation of Article 370, with the court previously stating that statehood must be restored expeditiously. The Central Government, through its representative, stated that the situation on the ground is peculiar and that "this particular stage is not the stage to muddy the waters. There are peculiar situations in this part of the country." The court acknowledged that ground realities, including events in Pahalgam, cannot be ignored. The 2023 Supreme Court judgment on Article 370 had noted the Centre’s assurance of statehood restoration and elections, leading the court to not delve into the legal validity of downgrading a state to a Union Territory at that time. This legal question, along with the restoration of statehood, has now returned to the Supreme Court.
