The Supreme Court has pulled up the Election Commission of India (ECI) over the use of Aadhaar for voter verification in Bihar. The court stated that the poll panel cannot decide who is a citizen and should not enter the Home Ministry’s domain. The SC questioned the ECI’s authority to compel voters to prove their citizenship and warned against linking this exercise to the upcoming Bihar polls. The court also noted that the process of verification requires more time and should not be rushed before elections. The ECI defended its actions, claiming it as a routine exercise. Senior advocates Kapil Sibal and A.N. Singhvi argued that the ECI’s documentation requirements exclude common identity proofs held by the majority of Bihar’s population.
