A five-judge Supreme Court bench has ruled on the powers of the President and Governors regarding assent to bills, clarifying there is no set timeline for their decision. The verdict, which came on a presidential reference, addresses ongoing standoffs between state governments, including Tamil Nadu and Kerala, and their respective Governors. The ruling sets aside a previous two-judge bench order that had imposed a timeline. The court stated that the Governor’s power is limited to three options: ‘Give assent, send it back with comments or send it to the President. He cannot sit on a bill’. While Governors have sole discretion, they cannot indefinitely stall legislation, and the court can step in if there is an inexplicable, inordinate delay. Judicial review, however, will only be applicable after a bill is enacted into law.
