SC Reverses Order: No Timelines For President, Governors To Act On Bills | India Today

The Supreme Court delivers its opinion on a presidential reference regarding timelines for the President and Governors to act on bills passed by state legislatures. A five-judge bench led by Chief Justice B. R. Gawai held that courts cannot set timelines for these constitutional posts, but noted that Governors cannot stall bills endlessly. The DMK stated that the Governor in Tamil Nadu, R.N. Ravi, ‘who holds the constitutional position, time and again deliberately makes politically motivated decisions, thereby tarnishing the dignity of his position’. The opinion reverses an April 2025 judgment that had imposed a three-month timeline and declared the concept of ‘deemed assent’ to be alien to the Constitution. The court clarified that while the actions of a Governor are not justiciable, courts can issue directions in cases of prolonged inaction.
