SC On Comics: Commercial Speech Is Not Free Speech

The Supreme Court has taken action against stand-up comics for mocking specially-abled individuals, stating their content is commercial speech, not protected free speech. The court has directed the Ministry of Information and Broadcasting to establish guidelines to regulate language on social media, which it notes is currently unregulated unlike traditional media. The court observed, "when we start laughing at others…and that humour is generated to hurt persons, that causes a problem." This action was prompted by incidents including a joke by Samay Raina about persons with disabilities and a comedy sketch by Ranveer Allahbadia. The court has demanded the comedians involved display an apology on their social media platforms and warned of potential financial penalties. The ruling asserts that influencers using platforms to earn money have a social responsibility not to hurt sections of society.
