
The Supreme Court has dismissed a petition filed by Justice Yashwant Verma, challenging the recommendation for his impeachment. The recommendation was made by then CJI Sanjeev Khanna following the recovery of unaccounted cash from Justice Verma’s official residence in Delhi. A bench comprising Justices Deepankar Dutta and AG Masi ruled that the in-house inquiry into the matter was legally valid and that due process was followed. The court stated that uploading videos and photos of the search was unnecessary but did not affect the legality of the proceedings. It also clarified that the Chief Justice’s communication to the Prime Minister and President was not unconstitutional. The court found that Justice Verma’s fundamental rights had not been violated and that a writ petition against the in-house mechanism was not maintainable. The Supreme Court rejected the argument that the in-house inquiry amounted to a parallel procedure. The only door open for Justice Verma is to challenge his impeachment before the Parliament.
