The Supreme Court of India is set to hear a petition filed by Justice Yashwant Varma of the Allahabad High Court on July 28, 2025, challenging the findings of a three-judge in-house inquiry committee. The committee indicted him following the discovery of a large amount of unaccounted cash at his official residence in Delhi after a fire on March 14, 2025. The panel, comprising Chief Justice Sheel Nagu (Punjab and Haryana High Court), Chief Justice G.S. Sandhawalia (Himachal Pradesh High Court), and Justice Anu Sivaraman (Karnataka High Court), concluded that the cash was under Justice Varma’s or his family’s “covert or active control” and that he failed to provide a convincing explanation, alleging instead that he was being framed. Justice Varma’s plea argues that the in-house inquiry process is “extra-constitutional,” violates his rights, and usurps Parliament’s authority under Articles 124 and 218, which govern the impeachment of judges. The inquiry’s findings led to a recommendation by former Chief Justice of India Sanjiv Khanna for impeachment proceedings, prompting Justice Varma’s transfer from the Delhi High Court to the Allahabad High Court and the suspension of his judicial duties. The Supreme Court bench, comprising Justices Dipankar Datta and Augustine George Masih, will hear the case, with Chief Justice B.R. Gavai recusing himself due to prior involvement in discussions. The controversy has sparked significant debate over judicial accountability and transparency, with 152 MPs across parties supporting an impeachment motion in Parliament.
