
In an interview with India Today, former Supreme Court judge Justice Deepak Gupta defended the Supreme Court’s intervention against an NCERT textbook that discussed judicial corruption. He argued that while constitutional institutions should be open to scrutiny, the Class 8 textbook presented a one-sided view that only highlighted weaknesses without acknowledging the judiciary’s strengths. Justice Gupta stated, ‘I feel that the judiciary is being maligned so that people lose faith in the judiciary.’ He warned that loss of faith in the judiciary could lead to anarchy and pointed to mob lynchings as examples of people bypassing legal institutions. Justice Gupta dismissed claims that the court’s action was disproportionate, saying it was ‘a very well measured action.’ He emphasised that he himself has been critical of Supreme Court judgments but maintained that painting the entire institution negatively in a textbook for young students was inappropriate. He clarified that the court’s order does not stifle legitimate criticism at higher levels of discourse.
