President-elect Donald Trump is scheduled for sentencing on January 10, just days before his inauguration. This follows Manhattan Judge Juan M. Merchan’s surprise ruling, which denied Trump’s requests to overturn his conviction or dismiss the case. Trump, convicted in May 2024 on 34 felony counts of falsifying business records, faces sentencing in a case tied to a $130,000 hush money payment to adult film star Stormy Daniels. The payment was allegedly made to suppress her claims of an affair, which Trump denies.
While Trump’s legal team has criticized the case as unconstitutional and sought delays, Judge Merchan has decided to proceed with sentencing. The charges carry a potential range of penalties, from fines or probation to a maximum of four years in prison. However, the judge suggested that an "unconditional discharge" may be the most practical option—concluding the case without imprisonment, fines, or probation but leaving the conviction intact.
This historic development marks the first time a U.S. president—former or sitting—faces sentencing for a criminal conviction. Trump, who won the 2024 election, could return to the White House with a felony on his record, a prospect that has raised significant legal and constitutional questions.
