In a major legal relief for the Congress, a Delhi court on Tuesday dismissed the Enforcement Directorate’s (ED) money laundering complaint against Sonia and Rahul Gandhi in the National Herald case. Senior Advocate and Congress MP Abhishek Manu Singhvi, appearing for the Gandhis, termed the ED’s investigation ‘null and void’ due to the absence of a predicate offence or FIR. Speaking to India Today, Singhvi argued that the ‘process is the punishment’ and cited the Supreme Court’s Vijay Madanlal Choudhary judgment. Special Judge Vishal Gogne of the Rouse Avenue Court refused to take cognizance, noting the lack of a police FIR at the time of the complaint. Singhvi dismissed the new FIR filed by the Delhi Police EOW in October as a ‘rehash’. The ED is expected to appeal the order.
